Acceptance of these terms
These Terms and Conditions are an agreement between you and Sky Point Athletics LLC, doing business as Sky Point Gymnastics (“Sky Point,” “we,” “us,” or “our”). By accessing or using our website, submitting an inquiry, or using a website feature that links to these terms, you agree to them and to our Privacy Policy.
If you do not agree, do not use the website. You must be at least 18 years old and legally able to enter into an agreement to submit a form or request services through this website.
Website purpose
The website provides general information about Sky Point, planned and available programs, enrollment opportunities, events, employment opportunities, and ways to contact us. Website content is informational and may change as schedules, staffing, capacity, pricing, and facility plans are finalized.
A website inquiry, interest form, evaluation request, or founding-family form is not registration, enrollment, team placement, an appointment, or a guarantee of availability. Unless Sky Point expressly confirms otherwise in writing, it does not reserve a class, promotional benefit, or place on a team.
Enrollment and participation
Actual enrollment and participation may require a separate registration process and acceptance of additional agreements, including payment terms, tuition and cancellation policies, waivers, assumption-of-risk terms, medical authorization, photo or video choices, team policies, and facility rules. If those agreements conflict with these website terms on an enrollment or participation issue, the specific enrollment or participation agreement controls.
Gymnastics and related physical activities involve inherent risks. These website terms are not a participation waiver and do not replace the separate waivers and acknowledgments required before participation.
Founding-family and other offers
Promotional offers are subject to stated eligibility rules, availability, timing, and completed enrollment requirements. Submitting an interest form does not reserve or guarantee an offer. For the founding-family launch offer, eligibility is determined by the order of completed qualifying new-gymnast enrollments in Sky Point’s registration system, not by the order of website inquiries. Offers may not be combined unless expressly stated and may be changed or withdrawn before qualifying enrollment, subject to applicable law.
Communications and SMS terms
When you provide contact information, you authorize Sky Point to respond using the methods you request or otherwise permit. Operational messages may concern an inquiry, class matching, evaluations, scheduling, enrollment, account activity, or a requested service. Promotional email or text messages will be sent only with the consent required by law.
- Marketing consent is not a condition of purchasing or enrolling.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to opt out of text messages from the sending number.
- Reply HELP for help, call 407-868-2989, or email skypointgymnastics@gmail.com.
- Carriers are not liable for delayed or undelivered messages.
- Your mobile opt-in information will not be sold or shared with third parties for their own marketing.
We may change or end a messaging program. Opting out of promotional messages does not cancel an enrollment, requested appointment, or other agreement with Sky Point.
Accurate information and adult responsibility
You agree to provide accurate, current information and to submit information about a minor only if you are the child’s parent, legal guardian, or otherwise authorized to do so. Children should not submit information through this website. You are responsible for keeping your contact information current and for the activity associated with any account you create through an enrollment provider.
Acceptable use
You may use the website only for lawful, personal, and legitimate business purposes. You may not:
- Interfere with the website, its security, or another person’s use.
- Attempt unauthorized access to systems, accounts, data, or source code.
- Use automated tools to scrape, copy, overload, or test the website without written permission.
- Submit false, misleading, infringing, harmful, or unlawful material.
- Impersonate another person or misrepresent your authority regarding a child.
- Use website content or contact information for spam, solicitation, or unlawful activity.
Intellectual property
The website and its text, design, graphics, logos, photographs, video, and other content are owned by Sky Point or used with permission and are protected by applicable intellectual-property laws. Third-party services and links
We may link to or use third-party services for registration, family accounts, payments, donations, maps, communications, social media, or other functions. We do not control third-party services and are not responsible for their content, availability, security, or practices. Your use of a third-party service is governed by its own terms and privacy notice.
Disclaimers
We work to keep website information useful and accurate, but the website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Sky Point disclaims warranties regarding uninterrupted access, error-free operation, completeness, accuracy, fitness for a particular purpose, and noninfringement. Program descriptions, schedules, dates, staffing, prices, capacity, and opening information may change. Nothing on the website is medical, legal, or professional safety advice.
Limitation of liability
To the fullest extent permitted by law, Sky Point and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the website or a third-party link. Nothing in these terms excludes liability that cannot lawfully be excluded. Separate participation agreements govern claims related to gymnastics activities and facility participation.
Governing law and disputes
Florida law governs these terms, without regard to conflict-of-law principles. Any dispute concerning these website terms that is not governed by another signed agreement must be brought in a court of competent jurisdiction in Orange County, Florida, unless applicable law requires otherwise.
Changes, severability, and contact
We may update these terms by posting a revised version and changing the effective date. Continued use after an update means you accept the revised terms. If a provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
